{"id":555,"date":"2013-10-10T12:26:53","date_gmt":"2013-10-10T17:26:53","guid":{"rendered":"https:\/\/kevinkgipson.com\/?p=555"},"modified":"2013-10-10T12:26:53","modified_gmt":"2013-10-10T17:26:53","slug":"federal-bankruptcy-courts-to-stay-open-for-a-few-more-days","status":"publish","type":"post","link":"https:\/\/kevinkgipson.com\/?p=555","title":{"rendered":"Federal Bankruptcy Courts To Stay Open For A Few More Days"},"content":{"rendered":"<p><a href=\"https:\/\/kevinkgipson.com\/wp-content\/uploads\/2013\/10\/Courts-Closed.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-557\" alt=\"Courts Closed\" src=\"https:\/\/kevinkgipson.com\/wp-content\/uploads\/2013\/10\/Courts-Closed-300x240.jpg\" width=\"300\" height=\"240\" srcset=\"https:\/\/kevinkgipson.com\/wp-content\/uploads\/2013\/10\/Courts-Closed-300x240.jpg 300w, https:\/\/kevinkgipson.com\/wp-content\/uploads\/2013\/10\/Courts-Closed.jpg 480w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>The Government Shutdown is now 10 days old.<\/p>\n<p>In a <a title=\"How A Government Shutdown Will Affect Bankruptcy Courts\" href=\"http:\/\/www.bankruptcylawnetwork.com\/how-a-government-shutdown-will-affect-bankruptcy-courts\/\" target=\"_blank\">recent article that I wrote <\/a>for the <a title=\"Bankruptcy Law Network Articles By Kevin Gipson\" href=\"http:\/\/www.bankruptcylawnetwork.com\/author\/kkgipson\/\" target=\"_blank\">Bankruptcy Law Network<\/a>\u00a0I discussed how the bankruptcy courts will be impacted by the government shutdown.<\/p>\n<p>In <a title=\"U.S. Court First Statement Regarding Government Shutdown\" href=\"http:\/\/news.uscourts.gov\/judiciary-open-during-government-shutdown\" target=\"_blank\">its initial statement <\/a>regarding the possible shutdown of the Federal Courts, the <a title=\"Administrative Office of the U.S. Courts on behalf of the Federal Judiciary\" href=\"http:\/\/www.uscourts.gov\/Home.aspx\" target=\"_blank\">Administrative Office of the U.S. Courts for the Federal Judiciary <\/a>advised that the courts would remain open until at least October 15, 2013.<\/p>\n<p>Today, the <a title=\"U.S. Bankruptcy Court, Eastern District of Louisiana\" href=\"http:\/\/www.laeb.uscourts.gov\/\" target=\"_blank\">U.S\u00a0Bankruptcy Court for the Eastern District of Louisiana <\/a>announced that they will now be open until at least October 17, 2013.<\/p>\n<p>Should the bankruptcy courts close due to the shutdown, the following results are likely:<\/p>\n<ul>\n<li>All hearings will be cancelled.\u00a0 This is a particular problem in <a title=\"Definition of Chapter 13\" href=\"https:\/\/kevinkgipson.com\/?page_id=36\" target=\"_blank\">Chapter 13 <\/a>cases where the payment plan needs to be confirmed by the court.<\/li>\n<li>Meetings of Creditors will likely be cancelled.\u00a0 Without the meeting the <a title=\"Definition of Discharge\" href=\"https:\/\/kevinkgipson.com\/?page_id=36\" target=\"_blank\">discharge<\/a> of debts in the bankruptcy will be delayed.<\/li>\n<li>Although it appears that the Case Management\/Electronic Case Filing (CM\/ECF) system, which is the Federal Judiciary&#8217;s<br \/>\nnational electronic-filing system will likely remain open to accept filings, there will likely be no court staff to process the filings.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>The Government Shutdown is now 10 days old.
